NOTICE OF PERSONAL DATA PROCESSING AND PRIVACY POLICY

With the purpose of protecting the data of the owners and guaranteeing their rights considering Law Nº 29733 of Personal Data Protection and its regulations; through the present document the Express Authorization is granted, in the following terms:
FIRST: BACKGROUND.
With the enactment of the Personal Data Protection Law (hereinafter the “Law”), we seek to guarantee the right to the protection of personal data of its owners. These rights include, to be informed in a detailed, simple, express, unequivocal manner and prior to its collection, about the purpose for which your personal data will be processed; who are or may be its recipients, the existence of the data bank in which it will be stored, as well as the identity and address of its owner and, if applicable, of the person or persons in charge of the processing of your personal data; the mandatory or optional nature of your answers to the questionnaire proposed to you, especially with regard to sensitive data; the transfer of personal data; the consequences of providing your personal data and of your refusal to do so; the time during which your personal data will be kept; and the possibility of exercising the rights granted to you by law and the means provided for this purpose.
SECOND: EXPRESS AUTHORIZATION.
By signing this document, the Grantor accepts and authorizes ALVAREZ LARREA EQUIPOS MEDICOS ALEM CIA LTDA, in a prior, free, express, unequivocal and informed manner. (hereinafter “ALEM”), as the responsible party, to consult, request, collect, store, circulate (report, transmit or transfer), use, delete or perform any processing of your Personal Data exclusively within the framework of commercial/employment relations, for any of its purposes.
Limitations on consent to the processing of personal data:
The consent of the owner of personal data is not required, for the purposes of its processing, in the following cases:
1. When personal data is collected or transferred for the exercise of the functions of public entities within the scope of their competences.
2. In the case of personal data contained or intended to be contained in sources accessible to the public.
3. When it concerns personal data related to the solvency and creditworthiness, in accordance with the law.
4. When there is a regulation for the promotion of competition in regulated markets issued in the exercise of the regulatory function by the regulatory agencies referred to in Law 27332, Framework Law of the Regulatory Agencies
of Private Investment in Public Services, or the one that takes its place, provided that the information provided is not used to the detriment of the user’s privacy.
5. When the personal data is necessary for the preparation, conclusion and execution of a contractual relationship to which the holder of personal data is a party, or when the personal data is derived from a scientific
or professional relationship of the holder and is necessary for its development or fulfillment.
6. When it concerns personal data related to health and it is necessary, in circumstances of risk, for the prevention, diagnosis and medical or surgical treatment of the holder, provided that such treatment is carried out in health establishments or by professionals in health sciences, observing professional secrecy; or when there are reasons of public interest provided by law or when it must be treated for reasons of public health, both reasons must be qualified as such by the Ministry of Health; or for the performance of epidemiological or analogous studies, as long as adequate dissociation procedures are applied.
7. When the processing is carried out by non-profit organizations whose purpose is political, religious or trade union and refers to personal data collected from their respective members, which must be related to the.
THIRD: DECLARATION.
3.1. By signing this Express Authorization, the Grantor declares to be of legal age, holder and legal representative and/or attorney-in-fact or authorized person.

3.2. Declares to be aware of the rights of the holders of Personal Data.

Declares that it was informed of the power to authorize the processing of sensitive data, understood as those that affect the privacy of the holder or whose improper use may generate discrimination, such as those that reveal racial or ethnic origin, political orientation, religious or philosophical convictions, membership in trade unions, social organizations, of human rights or that promote the interests of any political party or that guarantee the rights and guarantees of opposition political parties, as well as data related to health, sexual life, biometric data (fingerprint, iris of the eye, voice, gait, palm of the hand or facial features, among others) and any personal data of children and/or adolescents.
3.4. Likewise, you declare to know that, in case you do not authorize the processing of Personal Data for any of the purposes contained in this Express Authorization, to require additional information, in the event that you consider that ALEM gave a treatment contrary to the authorized or wish to update, modify or delete your information, you can contact the data controller through the email dlegal@alem.com.ec.
FOURTH: REVOCABILITY.
The consent given for the processing of Personal Data is revocable at any time, communicating it in the same manner in which it was given, expressly, unequivocally and freely.
